What is Maine's Law on Fireworks
8 MRS §§221-A(1-A) and (4) define “consumer fireworks” and “fireworks,” respectively. 8 MRS §223-A(2) states, in part, “The legislative body of a municipality may adopt an ordinance to prohibit or restrict the sale or use of consumer fireworks within the municipality.” 30-A MRS §7051(11) states, in part, “Plantations have the same powers and duties, and are subject to the same restrictions, as a municipality under the following provisions of this Title…the sale and use of consumer fireworks within the plantation, subject to Title 8, section 223 A.”
The definition of “litter” in 17 MRS §2263(2) includes "all waste materials resulting from the use of consumer fireworks." 17 MRS §§2263-A and 2264-A address prohibitions and penalties related to littering.
17-A MRS §501-A states, in part, "A person is guilty of disorderly conduct if…In a public place, the person intentionally or recklessly causes annoyance to others by intentionally…Making loud and unreasonable noise, including, but not limited to, loud and unreasonable noise resulting from the use of consumer fireworks…"
