Dear Honorable Members of the 132nd Legislature:

 

By the authority vested in me by Article IV, Part Third, Section 2 of the Constitution of the State of Maine, I am hereby vetoing LD 958, Act to Prohibit Eminent Domain on Existing Tribal Trust Lands.

 

L.D. 958 would amend the Maine Implementing Act (MIA) and the Mi'kmaq Nation Restoration Act (MNRA) by repealing language that could allow the State, under limited circumstances, to take land for public uses if that land is included within Penobscot or Passamaquoddy Indian Territory, or the Trust Lands of the Houlton Band of Maliseet Indians or the Mi'kmaq Nation ("Tribal Lands").

 

Current law already imposes strict limits on the State's ability to take any Tribal lands for public uses, requiring that there is “no reasonably feasible alternative” to the taking and ensuring substitute lands are acquired so there is no net loss in lands to the affected Tribe. 30 M.R.S.A. §§ 6205(3)(A), 6205-A & 7204.

 


It is important to note at the outset that if this bill were enacted and ratified by the four Tribes covered by MIA and MNRA, it would be a permanent and irrevocable change to current law.  This is the case because federal law authorizes the Maine Legislature to make changes to MIA and MNRA, but only with the consent of the affected Tribes. When the Legislature amends these statutes, and the Tribes consent to those amendments, the Legislature cannot unilaterally repeal or amend the new language in the future, even if problems with that language become obvious later. The Legislature should understand that this bill would permanently deny the State the ability to take even small portions of Tribal Lands abutting public rights of way for uses like road and bridge projects no matter what circumstances may arise many years into the future.

 

My approach to legislation addressing Tribal-jurisdictional issues has been consistent. I have supported identifying a specific problem and working together collaboratively with Tribal leaders to develop clear language with well understood consequences to resolve that problem.  Proceeding in this way has not been easy.  To be sure, it has not been politically expedient.  It takes time and effort, but it has produced excellent results.  Our constructive engagement with Wabanaki partners has produced a long list of legislative successes on issues including water quality standards to protect sustenance fishing, a ban on Native American mascots, exclusive rights to operate on-line sports wagering, and preferential tax treatment for Tribal members and Tribal businesses.  We put into law a first-in-the-nation Tribal-State collaboration process. We enacted legislation ensuring the Wabanaki Nations receive the benefits and protections of the Violence Against Women Act, the Indian Child Welfare Act, the Safe Drinking Water Act.  And we enacted landmark legislation providing the Mi'kmaq Nation the same rights and authorities as the other Wabanaki Nations.

 

These legislative accomplishments came as the result of numerous meetings and conversations.  I have personally met with Wabanaki Chiefs, sometimes together, and often individually, on many occasions.  I have met with them before and during this legislative session. Never once in these discussions did any Tribal leader mention the issue of state eminent domain authority as a problem that should be addressed. The testimony presented to Judiciary Committee on this bill confirmed that no problem exists here.  No one identified a single example of a dispute or difference of opinion of any kind regarding the exercise of eminent domain authority as to Tribal land since the Maine Implementing Act was enacted in 1980.  In fact, both the testimony and the discussion at the work session showed just the opposite. By all accounts, State and Tribal interactions in this area have been a model of respectful and collaborative problem solving.

 

Against this background, it is a mystery to me why this bill was introduced.  L.D. 958 is a solution in search of a problem, and yet it could have serious unintended consequences years from now that are impossible to know today.  It would be a mistake to permanently bar future generations from exercising this important but seldom used authority no matter what the needs of society may be many decades into the future.


For these reasons, I return L.D. 958 unsigned and vetoed, and I urge the Legislature to sustain this veto.

Dear Honorable Members of the 132nd Legislature:

 

By the authority vested in me by Article IV, Part Third, Section 2 of the Constitution of the State of Maine, I am hereby vetoing L.D. 1328, An Act to Create Culturally Appropriate and Trauma informed Housing and Recovery Services.”  This bill would require MaineHousing to receive and make available either public or private funds for the acquisition or operation of two recovery houses that are led by “individuals qualified to provide culturally appropriate services to serve underserved, underrepresented and disparately impacted” people in substance use recovery.  MaineHousing would be further required to distribute these funds through a competitive bid process to grantees.

 

MaineHousing’s mission is helping Maine people own, rent, repair, and heat their homes. It is an independent state authority created to address the problems of unsafe, unsuitable, overcrowded, and unaffordable housing.  The agency has no expertise managing recovery housing, evaluating whether the counselling and other services provided for individuals in recovery from substance abuse are delivered  on a professional level, or whether those services are effective.  Furthermore, MaineHousing is a financing agency and does not own any residential properties; LD 1328 does not specify who would own these projects or how they would be acquired.  And importantly, the bill provides no funding.

 


While recovery housing is important for helping individuals with substance abuse disorder find stable housing and work on their recovery, MaineHousing is not the appropriate agency to administer recovery housing for any population.

 

For these reasons, I return L.D. 1328 unsigned and vetoed, and I urge the Legislature to sustain this veto.

            (5-32)  the Town of Hudson on the celebration of the town's 200th Anniversary.  Hudson, originally incorporated as the Town of Kirkland in 1825, was settled by hardy pioneers drawn by the promise of fertile farmland and abundant timber.  These early settlers cleared dense forests, built log cabins and established the first farms.  In 1854, the town was renamed Hudson, after Hudson, Massachusetts, where many of the settlers came from.  Nestled between rolling hills and tranquil lakes, Hudson today is a vibrant rural town with a population just under 1,500.  Its natural beauty, marked by the north end of Pushaw Lake, Little Pushaw Pond, miles of forest and bogs and abundant wildlife, attracts nature lovers and outdoor enthusiasts.  We extend to the citizens of the Town of Hudson our congratulations and best wishes on the town's Bicentennial;

In Memory of:

 

            (5-34)  the Honorable Norman E. Weymouth, of West Gardiner.  Mr. Weymouth taught Civics at Gardiner Area High School for 25 years and served on the Select Board of Manchester for over a decade.  He served in the Maine House of Representatives in the 110th, 111th, 112th and 113th Legislatures, representing the towns of Farmingdale, Litchfield, Randolph and West Gardiner, and he served in the Maine Senate in the 114th Legislature, representing the towns of Farmingdale, Gardiner, Litchfield, Manchester, Monmouth, Pittston, Randolph, Readfield, Wayne, West Gardiner, Winthrop and Whitefield.  While in the House and Senate, his committee work included Election Laws, Public Utilities, Fisheries and Wildlife and Housing and Economic Development.  Mr. Weymouth will be long remembered and sadly missed by his wife, Adelaide, and his family, friends and community;

            (5-35)  Michael S. Babcock, of West Gardiner.  Mr. Babcock spent most of his working life as a tin smith at Bath Iron Works, and he was very active within the deaf community.  Mr. Babcock will be long remembered and sadly missed by his family, friends and community;

            (5-36)  James Barry Roche, of Farmingdale.  Mr. Roche was a salesman driven by integrity and purpose.  After gaining experience at Blanchard and Sons, he founded J.B. Roche & Company, Inc. in the 1970s, selling and installing fire and safety systems throughout New England.  Mr. Roche will be long remembered and sadly missed by his family, friends and community;

            (5-37)  Shelly Harris Gerstein, of Readfield.  Mr. Gerstein was a writer, editor, magazine publisher, software and web developer and business consultant.  Mr. Gerstein will be long remembered and sadly missed by his family, friends and community;

            (5-38)  Paul DeWitt Colbath, Jr., of Waldoboro.  Mr. Colbath was a veteran of both the United States Coast Guard and the United States Army.  He served in Korea for a year.  He went on to work at Ohio Edison Company in Warren, Ohio and, for eleven years, as an auto mechanic.  Moving to Bridgton, he worked as a cook at Bridgton Academy and at several restaurants and worked as a cook/supervisor at Stephens Memorial Hospital for fifteen years.  He also operated for a time a drive-through coffee and breakfast business in Bridgton.  Later in life, Mr. Colbath and his wife, Linda, moved to Waldoboro, where he brought joy by cooking for family and friends.  Mr. Colbath will be long remembered and sadly missed by his family, friends and community;

            (5-39)  Eunice Ann Mercier, of Gardiner.  Ms. Mercier lived and worked in the Augusta area her entire life.  She worked for the State of Maine at the Public Health Laboratory and for Augusta General, retiring in 1990 after 28 years of service.  In her retirement, she volunteered at the Augusta Food Bank.  Ms. Mercier will be long remembered and sadly missed by her family, friends and community;

            (5-40)  Ralph P. Buzzell, formerly of Gardiner.  Mr. Buzzell served in the United States Air Force from 1952 to 1956, during the Korean War, as a flight crew chief.  He was stationed in Japan for 18 months.  After his military service, he worked as an insurance industry professional for Kemper and Worcester Mutual, retiring from The Hanover Insurance Group in Portland in the mid-1990s.  His career took him to Massachusetts and Connecticut.  In 1969 he and his wife Harriet moved from North Haven, Connecticut and settled in Gardiner to raise their family.  Together, they served their community by volunteering at the Winter Street Baptist Church, at the Gardiner Food Bank and at their retirement community, Shady Oaks, in Zephyrhills, Florida, where they resided six months of the year for 20 years.  Their time in Florida was spent developing many dear friendships and enjoying the loving fellowship at the Temple Baptist Church in Dade City, Florida.  Mr. Buzzell will be long remembered and sadly missed by his family, friends and community;

            (5-41)  Dawn P. Hodsdon, of North Monmouth.  Ms. Hodsdon was the principal owner of Ed Hodsdon Masonry for nearly 30 years.  Ms. Hodsdon will be long remembered and sadly missed by her family, friends and community;

            (5-42)  Marion Louise Thomas, of Gardiner.  Ms. Thomas was employed by Health-Tex as a stitcher before she worked in the company's office as Payroll Clerk.  She also worked at TW Dick Steel Company as Accounts Receivable Bookkeeper and Credit Manager and at Williams Construction Company as Accounts Payable Bookkeeper.  She was active in many groups and clubs in the area, holding various offices in most of them, including the Gardiner Emblem Club, Four Leaf Clover Senior Citizens Club of Gardiner, Red Hat Society, Rubies Cuties Chapter, AARP Chapter 511 and Maine General Medical Center Auxiliary.  She volunteered in the Hospital Gift Shop for many years.  She also was a longtime member of the National Association of Women in Construction, traveling with them throughout the United States for conventions and conferences representing the Maine State Chapter #276.  In 2023, she was honored with a scholarship in her name for high school students entering the construction and engineering fields.  Ms. Thomas will be long remembered and sadly missed by her family, friends and community;

            (5-43)  Coplin Douglas Fickett, of Durham.  Mr. Fickett was an avid whitewater kayaker and loved to travel and chase big water, from the Zambezi in Africa to the Futaleufu in Chile.  A woodworker, he enjoyed making custom furniture.  He worked at Abbott Laboratories.  Mr. Fickett will be long remembered and sadly missed by his family, friends and community;

            (5-44)  Richard J. Coleman, of Winthrop.  Mr. Coleman worked at Progressive Distribution Center until his retirement.  He then worked at Cumberland Farms, where he was happiest when interacting with and helping others.  He was active in the community, serving with Keep Winthrop Warm, The Rotary Club, Winthrop Food Pantry and the Board of Trustees of Winthrop Utilities.  Mr. Coleman will be long remembered and sadly missed by his family, friends and community;

            (5-45)  Joel D. Sankey, of Brewer.  Mr. Sankey was a veteran of the United States Air Force, serving during the Vietnam War from 1967 to 1970.  After his service, he moved to Brewer and served the Bucksport community and other communities as an educator and coach.  He devoted over 50 years of his life to teaching history at Bucksport High School.  In addition to being a teacher who was beloved by his students, Mr. Sankey was a respected coach, mentoring student-athletes in football, basketball and track at Bucksport High School, Maine Maritime Academy and Bangor High School.  In 2004, he coached the Bucksport Golden Bucks to a Class C State Football Championship.  Mr. Sankey will be long remembered and sadly missed by his family, friends and community;

            WHEREAS,  on February 25, 2025, Representative Laurel D. Libby of Auburn was censured by the House of Representatives in House Resolution 1 pursuant to Article IV, Part Third, Section 4 of the Constitution of Maine and Section 561, subsection 1 of Mason's Manual of Legislative Procedure; and

 

            WHEREAS,  as a consequence of Representative Libby not comporting with the censure, restrictions were placed on the voting and speaking privileges of Representative Libby pursuant to House Rule 401, subsection 11; now, therefore, be it

 

            RESOLVED: That We, the Members of the House of Representatives of the One Hundred and Thirty-second Legislature now assembled in the First Special Session, hereby rescind, effective upon adjournment sine die of the First Special Session of the One Hundred and Thirty-second Legislature, the restrictions on the voting and speaking privileges of Representative Libby; and be it further

 

            RESOLVED: That this resolution must be entered on the journal of the House of Representatives.
