Introduction

Prior to 1820, Maine was part of Massachusetts and known as the District of Maine. Beginning in 1785, the people of the District made several attempts to gain their independence from Massachusetts. Finally, in 1819, the Massachusetts General Court passed the Act of Separation allowing the people of the District of Maine to vote on independence. The vote was held in July 1819 and was approved.

Maine held its Constitutional Convention on October 11, 1819 to draft a constitution. The convention adopted the draft on October 29, 1819. A vote of the people to adopt it was held on December 6, 1819 and was approved. The constitution took effect on Maine's admission to the Union as the twenty-third state on March 15, 1820.

The first amendment to the Maine Constitution was approved in 1834. As of November 2023, 177 amendments have been approved to amend the Maine Constitution.

Constitutional Amendment Legislative Procedure

If the Legislature approves a resolution proposing a constitutional amendment by the necessary two-thirds vote of the members present in both chambers, that resolution must be submitted to the people for a referendum at the next general election. Constitutional amendments do not require approval by the Governor, but must be approved by a majority of voters (Maine Constitution, Art. X, §4).

The Maine Constitution has also been changed as a result of the codification process; for example, renumbering parts or sections after language has been repealed or omitting language no longer in force because it was ruled federally unconstitutional. Starting in 1973, the Maine Constitution undergoes codification every 10 years. In 1955 and 1965, the constitution was codified as part of the revisions to the statutes. Prior to 1955, it was rearranged only once, in 1876, to incorporate amendments enacted since 1820. Consult the Bibliography to find detailed notes about changes made by these codifications.
