Sec. 1. 25 MRSA §1551 is enacted to read:

§1551. Accuracy of information

1. Accurate records and release. The State Bureau of Identification shall by rule establish procedures to ensure that any information maintained by the bureau that is released in response to a criminal history record check request:

A. Is current and valid;

B. Accurately identifies the individual who is the subject of the request; and

C. Is released in accordance with law.

2.__Rules.__Rules adopted pursuant to this section are routine technical rules as defined in Title 5, chapter 375, subchapter 2- A.

SUMMARY

This bill requires the State Bureau of Identification within the State Police under the Department of Safety to establish procedures by rule to ensure that information that is released as part of a criminal history record check is current and valid, identifies the correct individual and is released in accordance with law.
