Sec. 1. 17-A MRSA §1252, sub-§2-B is enacted to read:

2-B.__In a case in which the State pleads and proves that a person has committed a crime under chapter 11 or 12, the court, in addition to any other orders it determines appropriate, shall order that a presentence investigation be conducted by the Department of Corrections prior to imposing sentence.__The presentence investigation must include results from risk assessment tools identified and applied by the Department of Corrections.

SUMMARY

This bill requires that every person who is convicted of a sex offense under the Maine Revised Statutes, Title 17-A, chapter 11 or 12, undergo a presentence investigation conducted by the Department of Corrections prior to the court's imposing a sentence.
