D.__In accordance with the Maine Administrative Procedure
Act, develop industry standards for uniform location
agreements to be used as the basis of agreements between
video lottery terminal distributors and licensees under
this chapter.

 
§365.__Powers and duties of director

 
1.__Powers.__In addition to powers conferred by any other
provision of law, the director may:

 
A.__Propose to the commission rules for adoption necessary
to administer and enforce this chapter, including rules to
be adopted jointly with the Chief of the State Police.__
These rules are routine technical rules as defined in
Title 5, chapter 375, subchapter 2-A; and

 
B.__Subject to approval of the commission and to any
applicable laws relating to public contracts, enter into a
contract for performance of the director's duties under
this chapter.__All contracts must be awarded in accordance
with rules adopted by the Department of Administrative and
Financial Services pursuant to Title 5, chapters 141 to
145 and Title 5, sections 1812 and 1813.__A contract
awarded or entered into by the director may not be
assigned by the holder of the contract, except by specific
approval of the commission.

 
2.__Duties.__The director shall:

 
A.__Develop, install and test a central computer system
with dial-up polling to all video lottery terminals
licensed under section 372 to provide auditing program
information.__The system must use continuous on-line
polling.__The central computer system may not limit
participation to only one manufacturer of video lottery
terminals by either the cost in implementing the necessary
program modifications to communicate or the inability to
communicate with the central computer system;

 
B.__Maintain and monitor the central computer system under
paragraph A to ensure compliance with this chapter;

 
C.__Attempt to determine the cause of any video lottery
terminal malfunction detected by the central computer
system under paragraph A and notify the Chief of the State
Police of any suspected tampering with a video lottery
terminal or any other violation of this chapter or the
rules adopted under this chapter;
