2.__Disciplinary action.__The commissioner may deny, suspend, revoke or refuse to renew a license pursuant to Title 5, section 10004 or Title 10, section 8003.__The commissioner's actions may be based upon any of the following grounds:

A. The practice of fraud or deceit in obtaining a license under this chapter or in connection with a service within the scope of the license issued;

B.__Habitual substance abuse that has resulted in or is foreseeably likely to result in the licensed person performing a service in a manner that compromises, threatens or adversely affects a client's legal rights or interests;

C.__A current medical finding of mental incompetence that adversely affects the licensed person's ability to perform the services of a legal document technician;

D.__Gross negligence by the licensed person that has compromised, threatened or adversely affected a client's legal rights or interests;

E.__Aiding or abetting a person not licensed under this chapter in the unauthorized practice of legal document technician;

F.__The licensed person has been subject to a legal determination listed in section 15303, subsection 2, paragraph D;

G.__Revocation in any jurisdiction of a professional or occupational license, certification or registration for disciplinary reasons or rejection of any application for reasons relating to untrustworthiness, beginning 3 years before the date of application; or

H.__Violating any provision of this chapter or any rule of the department.

3.__Procedure.__Except as provided in Title 5, section 10004, a license may not be suspended, revoked or refused for renewal for a reason set forth in subsection 2 without prior
