Dear Honorable Members of the 131st Legislature:
By the authority vested in me by Article IV, Part Third, Section 2 of the Constitution of the State of Maine, I am hereby vetoing L.D. 398, An Act To Make Agricultural Workers and Other Related Workers Employees Under Wage and Hour Laws.
I take this action reluctantly because I strongly support a minimum wage for farm workers.
L.D. 398 began as a proposal primarily requiring overtime pay for individuals employed in canning, processing, preserving, freezing, drying, marketing, storing, packing or distributing agricultural produce, meat and fish products and perishable foods. It then metamorphosed into a bill to create an “Agricultural Employees Concerted Activity Protection Act.” On the last night of the regular legislative session, the bill was substantially amended yet again and scaled back significantly. This bill, as amended in its final form, appears to affect only the minimum wage and the overtime provisions of Title 26 as they pertain to agricultural employees.
But this confusing evolution of the legislation has led to a series of questions from members of the agricultural community about the true scope of the language. For example, “agricultural workers” and “agricultural labor” are terms used elsewhere in Maine law for other, different purposes and members of the agricultural community now justifiably wonder whether the engrossed version of LD 398 also affects in some unintended way some other provisions of State or Federal labor laws dealing with unemployment, independent contractor status, records of payment and piecework compensation – parts of law that were not intended to be dealt with under this bill.
Ideally, I would have requested that the Legislature recall this bill from my desk in order to clarify for all affected parties what the bill does and does not do and what aspects of farm employment it may or may not change. However, because the Legislature is not in session this week, a recall before the expiration of the ten-day window required by the Maine Constitution is not possible.
To continue the discussion and promote consensus surrounding the issues this bill has presented, my only option then is to return the bill to this Legislature with my objections and to reconstitute the stakeholder group.
Therefore, in the coming weeks, I will issue an Executive Order to reestablish the stakeholder group in a more formal fashion in order to allow for a longer and more in-depth analysis of the bill’s provisions and the relationship of the change in definition of “employee” to other measures that affect agricultural work.
Out of this work, I believe we can arrive at a shared understanding of how to implement a minimum wage bill for farmworkers, at which point I will present a Governor’s bill during the Second Regular Session of this Legislature to address these issues without the confusion that now surrounds this bill.
For the reasons set forth above, I return L.D. 398 unsigned and vetoed, and I urge the Legislature to sustain this veto.

Dear Honorable Members of the 131st Legislature:
By the authority vested in me by Article IV, Part Third, Section 2 of the Constitution of the State of Maine, I am hereby vetoing L.D. 1610, An Act To Prohibit Campaign Spending by Foreign Governments and Promote An Anti-Corruption Amendment to the United States Constitution.
L.D. 1610 attempts to prohibit businesses and other entities with foreign government “influence” – a term that is poorly defined in the bill – from participating in both candidate elections and the citizen-initiated referendum process through monetary expenditures. On this point, the bill is similar to L.D. 194, An Act to Prohibit Contributions, Expenditures, and Participation by Foreign Government-owned Entities to Influence Referenda (130th Legis. 2021), a bill I vetoed last session due to potential Constitutional issues.
My concerns about the Constitutionality of the bill remain. But more broadly, while I strongly support and share the desire to find ways to prevent foreign influence in our elections, the language of the bill is too broad and would likely result in the unintended consequence of effectively silencing legitimate voices, including Maine-based businesses, in debates that would impact their interests.
On top of this concern, L.D. 1610 also attempts to regulate the activities of the press and other media outlets, which I believe runs afoul of the First Amendment and is counter to the longstanding tradition and cornerstone of a free press in America.
L.D. 1610’s Regulation of Political Speech
The core of the bill restricts who may participate in political debate, but the First Amendment provides its strongest protections to such political speech(Eu v. San Francisco County Democratic Central Comm., 489 U.S. 214, 223(1989)), with the Supreme Court generally rejecting restrictions on speech in political campaigns other than to prevent quid pro quostyle corruption (Fed. Election Comm’n v. Cruz, 132 S. Ct. 1638, 1652 (2022)).
L.D. 1610’s proponents point to a Federal District Court decision in Blumen v. FEC, 800 F. Supp. 281 (D.D.C. 2012), as support for the constitutionality of the bill’s prohibition on expenditures by foreign government-influenced entities. But Blumen involved the review of a very different law. At issue in that case was a prohibition only on contributions by foreign nationals,whereas this bill would also apply to Maine-based businesses that have, for example, investment from a public pension fund of a foreign city or province that has no interest in influencing a referendum. And importantly, Blumen only addressed a prohibition on contributions to candidates, political action committees, and political parties, all of which create the potential for quid pro quo corruption. This bill, however, also prohibits expenditures on citizen referenda; but the Supreme Court has explained that the risk of quid pro quo corruption “simply is not present in a popular vote on a public issue.” First Nat’l. Bank of Boston v. Bellotti, 98 S. Ct. 1407, 1423 (1978).
While some states have restrictions on foreign nationals and foreign corporations from participating in ballot initiatives, L.D. 1610 is different from those statutes in ways that are problematic:
1. L.D. 1610 does nothing to prohibit a foreign national from contributing to or making expenditures in a ballot initiative campaign;
2. The definition of a foreign entity as one that has 5 percent investment by a foreign government is so broad that it could theoretically incorporate businesses that are 95 percent owned and operated by citizens of Maine. Moreover, most states that bar foreign entities from contributing to a ballot initiative focus on where the business is incorporated or has its principal place of business. If the entity is a domestic subsidiary of a foreign business, they require United States citizens to determine how to make campaign donations. Here, however, the definition of a “foreign-influenced entity” requires one to know the level of foreign government investment in a privately held or publicly traded business – a much more in depth and difficult question to answer.
3. Under L.D. 1610, the same business that is barred from influencing the electorate as they consider a statute at referendum may retain a paid lobbyist to influence legislators as they consider enacting a statute – an odd and somewhat contradictory distinction to make that, in essence, says lawmakers are due certain information from certain messengers but not the people of Maine.
L.D. 1610’s Regulation of the Press and Media Outlets
Most troubling, however, is that L.D. 1610 attempts to regulate the activities of the press in two primary ways.
First, it requires internet platforms to “immediately remove” communications paid for by a foreign government-influenced entity, which is likely in violation of the First Amendment, and penalizes media outlets if they do not do so. But the Supreme Court has consistently protected the right of the press to carry truthful information of public concern, even when a third party violated the law in providing that information. Bartnicki v. Voper, 532 U.S. 514, 535 (2001). And paid advertising is entitled to the same First Amendment protection as editorial content. New York Times v. Sullivan, 376 U.S. 254, 265-66 (1964).
Second, L.D. 1610 also contains a “due diligence” provision that would require media outlets to ensure they do not publish communications “directly or indirectly” paid for – something that is, again, very difficult to discern – by a “foreign government-influenced entity,” under threat of significant financial penalties.
The Maine Association of Broadcasters, in urging me to veto this bill, wrote that this provision will “essentially require broadcast outlets to become detective agencies, tasked with investigating the source of funding for any and all campaigns.” Similarly, the Maine Press Association wrote that the provision “would restrict and burden speech about public issues in Maine by forcing news outlets to create an oppressive, time-consuming, and costly self-censorship regime.” I share these concerns and have enclosed their letters for the Legislature’s review and consideration.
Conclusion
While L.D. 1610 is flawed, I agree that we should, and we can, take a stand against dark money in our elections by reaffirming the Legislature’s support for an amendment to the U.S. Constitution, as described in Section 2 of L.D. 1610. And we can find a way to prevent foreign influence in our elections by enacting a more narrowly tailored and easily understood statute. Foreign actors have, and will, attempt to influence elections in America, but in attempting to protect our citizens from such nefarious actors, we should not create a bureaucratic morass that will entrap and silence otherwise legitimate voices and undermine the fundamental American cornerstones of free speech and free press. For the reasons set forth above, I return L.D. 1610 unsigned and vetoed, and I urge the Legislature to sustain this veto.

WHEREAS,in 1823, John O’Brien, Robert D. Dunning and John A. Dunning, all of Brunswick, conveyed real estate to the Town of Brunswick, including land that became Brunswick’s Lower Mall; and
WHEREAS, the deed to the town specified that the land was to be used only as a publicwalk or mall in perpetuity; and
WHEREAS, the Brunswick Town Mall serves as a gathering place for community residents at music concerts, art and Pride festivals, Civil War reenactments, winter ice skating, holiday tree lighting and many other special events and activities; and
WHEREAS, the Lower Mall is the site of Veterans Plaza, which is dedicated to all veterans and Merchant Marines from the Revolutionary War to the present;and
WHEREAS, the Lower Mall hosts a Farmers’ Market twice a week during warm months as well as up to 5 food truck vendors; and
WHEREAS, the extraordinary historical significance of the Brunswick Town Mall has been recognized by the designation of a Spanish‑American War Square; inclusion on the National Register of Historic Places in 1976; dedication of a statue of Joshua Chamberlain in 1983; placement of a plaque by the Rotary Club designating the Brunswick Town Mall as a local historic site in 2005; and installation of a monument on the Brunswick Town Mall to commemorate the 2020 Maine bicentennial; and

Mr. Blake lived in West Newbury, Massachusetts for over 30 years, where he was an active member of the community and a lieutenant with the West Newbury Volunteer Fire Department. He worked for 20 years driving trucks before working as a dispatcher and supervisor for Wings Express and Yellow Freight. Retiring to Peaks Island, he delivered meals on wheels and library books and was a member of the Lions Club. Mr. Blake will be long remembered and sadly missed by his wife of 73 years, Joan, his family and friends and all those whose lives he touched;

(5-31) Catherine Thelma Murphy, of Portland. Mrs. Murphy had a career in accounting. She contributed to several charitable organizations, including the Salvation Army and St. Jude, and regularly supported the Portland Public School System as well as her alma mater, John Bapst Memorial High School, in Bangor. Mrs. Murphy will be long remembered and sadly missed by her family and friends;

(5-32) James C. Peary, Sr., of Scarborough. Mr. Peary worked with his father at the family's auto repair business on Route 1 in Scarborough. He continued this work there for nearly 30 years. Upon his father's retirement, he took over the business and operated it until it was sold in 2002. He went on to work as an auto mechanic at Frank Galos Chevrolet in Saco for another 18 years, retiring in 2020. In his younger years, he was involved in stock car racing, driving in the Wildcat division at Beech Ridge Speedway in Scarborough. Mr. Peary will be long remembered and sadly missed by his wife of 48 years, Vicki, and his family and friends;

(5-33) James A. Vollkommer, of Gorham, a retired Colonel of the United States Air Force. Mr. Vollkommer served on active duty from 1953 to 1957 and in the active reserve from 1957 to 1985. He worked as a Methods Analyst/Programmer with Con Edison in New York from 1957 to 1959; Meteorologist for the National Weather Service at John F. Kennedy International Airport in New York from 1959 to 1966; Meteorologist-in-Charge at the National Weather Service Office in Burlington, Vermont from 1966 to 1971; Supervisory Meteorologist at the National Weather Service Forecast Office in Portland from 1971 to 1979; and Meteorologist-in-Charge at the National Weather Service Forecast Office in Portland from 1979 to 1991. He was a lifetime member of the Military Officers Association of America; lifetime member of the Reserve Officers Association; member and past president of the Southern Maine Chapter of the Military Officers Association of America; and member of the American Legion. He was a past member and past secretary of the Kiwanis Club of South Burlington, Vermont; member and past president of the Kiwanis Club of Portland; 4th Degree Knight of Columbus of St. Anne's Council in Gorham; past member and past chairman of the Board of Directors of Catholic Charities of Maine; and Lector and Eucharistic Minister at St. Anne's Church in Gorham, along with various other commissions of St. Anne's Church. Mr. Vollkommer will be long remembered and sadly missed by his wife of over 68 years, Marie, his family and friends and all those whose lives he touched;

(5-34) Stephen Levine, of Gorham. Mr. Levine was a veteran of the Maine Air National Guard and was stationed with the 265th Radio Relay Squadron in South Portland. He lived in Portland for 43 years before moving to Gorham. He worked at Freeport Shoe Company until the company closed in 1972. He then worked at Loree Shoe in Freeport as the Assistant Superintendent and as an Accounting Systems Analyst at Associated Hospital Services of Maine. In 1981, he went to work at Bath Iron Works as a Systems Analyst. In 1996, he worked at Computer Sciences Corporation as Senior Member Tech Support until he retired in 2000. He had several part-time jobs after he retired, ending with the Census 2010, when he canvassed local neighborhoods as part of the census clean-up crew. In 2011, after he lost his left leg to cancer, he became a Certified Peer Visitor mentoring recent amputees as they adapted to their new life. He was a lifelong member of Temple Beth El in Portland, where he served as a board member for 40 years, including several terms as secretary and as treasurer. He was also on the board of The Cedars for many years, where he served as treasurer and emeritus board member. Mr. Levine will be long remembered and sadly missed by his family and friends and all those whose lives he touched;

(5-35) Frances Elizabeth Silsby, of Gorham. Mrs. Silsby worked as a public health nurse in Hancock and Washington counties before moving to Augusta in 1955. She later moved to Gorham in 2014. She worked for the State of Maine's Disability Determination Services for nearly 25 years as a disability claims examiner and adjudicator, and she was a longstanding member of the service sorority Beta Sigma Phi. Mrs. Silsby will be long remembered and sadly missed by her family and friends and all those whose lives she touched;

(5-36) Anne Gartner, of Scarborough. Early in her life, Mrs. Gartner spent time in Germany, teaching kindergarten on an American military base in Munich. In the mid-1950s, she relocated to New York City, working as a secretary for Henry Dreyfuss Associates, a pioneering industrial design firm. In 2004, after 43 years in Manhattan, she retired to Scarborough. Her enthusiasm for fundraising and talent for organizational management made her leadership invaluable to many organizations, including The New York Junior League, Smith College, The Causeway Club, Jersey Reality and Investment Corporation and Union Theological Seminary. Mrs. Gartner will be long remembered and sadly missed by her family and friends;

(5-38) James Montell, of Gardiner. Mr. Montell was a veteran of the United States Army, fighting in Korea from 1952 to 1954. After moving to Maine and working in several jobs, he became a teacher at Gardiner Area High School, where he taught for eight years as a math and history teacher and served as a freshman football coach. He also officiated several sports, including baseball and football, and worked summers as Hallowell's recreation director. Most of his working life was spent serving as Highway Safety Coordinator for the State's Department of Public Safety. He taught defensive driving and worked with many groups to help make Maine's roads safer. For 50 years, he and his wife Faye also had an antiques business, for which he promoted and managed antiques shows throughout central and southern Maine year-round. In retirement, he enjoyed driving for General Courier throughout New England. He was a member and board member of the former Temple Israel in Gardiner and a longstanding member and past board member of the Temple Beth El in Augusta. He was a former member and chairman of the Gardiner Planning Board and was involved with the Gardiner Rotary. Mr. Montell will be long remembered and sadly missed by his family and friends and community;

Mr. Parsons was a chef his whole life, working at John Martin Manor and Wrights Emporium before owning and operating the Sunrise Restaurant and Bakery in St. Albans for 21 years with his wife of 32 years, Ann. (5-40) David Morton, of Casco. Mr. Morton took on the role of the first full-time town manager of the Town of Casco at 22 years of age. He dedicated his entire career, spanning 41 years, to serving Casco, which allowed him to become longest tenured manager in one town in Maine. He was actively involved in Eco Maine and Regional Waste Systems, including a groundbreaking trip to Europe in the early 1980s studying advanced recycling facilities. Settling on Thomas Pond in Casco in 1978, he became very involved in his community, running the Bingo Tent at Casco Days, coaching various sports teams and serving as a scoutmaster, among many other pursuits. Mr. Morton will be long remembered and sadly missed by his wife of 48 years, Donna, his family and friends and all those whose lives he touched;

(5-41) Anne H. Brautigam, of Brunswick, a beloved mother, teacher and contributor to many missions and organizations. In the 1970s, Mrs. Brautigam founded an ecumenical preschool to serve children of low-income families, and she remained engaged in efforts to support early childhood education for three decades. She was a beloved member of St. Paul's Episcopal Church in Brunswick and a national officer of the Society of the Companions of the Holy Cross. She facilitated the local chapter of the Foreign Policy Association's Great Decisions program for many years. In recent years, she turned her focus to advocating for improved housing opportunities for New Mainers. Mrs. Brautigam will be long remembered and sadly missed by her husband of 69 years, Richard, her family and friends and all those whose lives she touched;

Mr. Foshay will be long remembered and sadly missed by his family and friends and all those whose lives he touched;

(5-43) Patricia Ann Rawson, of Mount Vernon. Mrs. Rawson began her career teaching health and physical education in Hermon. After spending time at home raising her children, she went back to teaching, first in Wayne and then Readfield as a literacy specialist. Over 30 years, she served as a mentor and adviser to hundreds of students. She also coached many sports teams, including girls basketball early in her teaching career and the Mount Vernon Elementary School softball team, and refereed field hockey games before coaching field hockey at Maranacook Community High School. Shortly after moving to Mount Vernon in the late 1970s, she became a volunteer emergency medical technician and helped start Mount Vernon Rescue, serving as director from 1981 until she retired in May 2023. With her colleagues, she started the annual "Giving Tree" tradition for Mount Vernon and Vienna in 1990. The annual Rescue Garage Sale was another community-wide gathering that she started and led for more than 20 years. She also served on multiple town committees, including Neighbors Driving Neighbors, Aging in Place, Community Partnerships, the Mount Vernon Community Center and the Travis Mills Foundation. Mrs. Rawson will be long remembered and sadly missed by her family and friends and all those whose lives she touched;
