§2660-B. Definitions
As used in this subchapter, unless the context otherwise indicates, the following terms have the following meanings.

Commission.
"Commission" means the Maine Public Drinking Water Commission.

2.
Community water system.
"Community water system" means a public water system that serves at least 15 service connections used by year-round residents or regularly serves at least 25 year-round residents.

3.
Division.
"Division" means the Division of Health Engineering within the Bureau of Health, Department of Human Services.

4.
Fund.
"Fund" means the Public Drinking Water Fund.

5.
Noncommunity water system.
"Noncommunity water system" means a public water system that is not a community water system. A noncommunity water system is either nontransient or transient, as follows.
A.
A nontransient, noncommunity water system serves at least 25 of the same persons for 6 months or more per year and may include, but is not limited to, a school, factory, industrial park or office building.

B.
A transient, noncommunity water system serves at least 25 persons, but not necessarily the same persons, for at least 60 days per year and may include, but is not limited to, a highway rest stop, seasonal restaurant, seasonal motel, golf course, park or campground. A bottled water company is a transient, noncommunity water system.

6.
Program.
"Program" means the Maine Public Drinking Water Control Program.

7.
Primacy.
"Primacy" means the federally delegated primary enforcement authority to adopt, implement and enforce federally mandated drinking water standards promulgated pursuant to the federal Safe Drinking Water Act as amended.
