CHAPTER 519, PART CCCC

     Sec. CCCC-1. Reimbursement of heating costs. Notwithstanding any provision of law or rule to the contrary, the Department of Health and Human Services shall amend its rules for the reimbursement of nursing facilities and residential care facilities to provide a one-time payment for increased heating costs incurred during the 2005-2006 heating season for nursing facilities and residential care facilities to be paid before July 1, 2006. The amount of $400,000 appropriated from the General Fund for this purpose must be used to reimburse residential care facilities for increased heating costs, regardless of any limitation otherwise applicable to reimbursement for residential care facilities. The amount of $300,000 allocated from Other Special Revenue Funds for this purpose must be used as the state share of Medicaid reimbursement, to be matched by federal financial participation funds, to reimburse nursing facilities for increased heating costs, regardless of any limitation or cap on routine costs otherwise applicable to the reimbursement for nursing facilities. If the full costs of heating for the 2005-2006 heating season cannot be met with the funds appropriated and allocated under this Part, the Department of Health and Human Services shall distribute the funds appropriated in this Part in proportion to the share of the total annual heating costs of these facilities funded through the General Fund that are set forth in each facility's recent MaineCare audited cost report for its fiscal year ending in 2004. If the MaineCare audit for 2004 has not been completed at the time of calculating the distribution of funds under this section, then the cost report for the fiscal year ending in 2004 as filed with the Department of Health and Human Services must be used. Rules adopted pursuant to this section are routine technical rules as defined in the Maine Revised Statutes, Title 5, chapter 375, subchapter 2-A.

     Sec. CCCC-2. Appropriations and allocations. The following appropriations and allocations are made.
