§480-R. Violations; enforcement

Violations.
A violation is any activity which takes place contrary to the provisions of a valid permit issued under this article or without a permit having been issued for that activity. Each day of a violation shall be considered a separate offense. A finding that any such violation has occurred shall be prima facie evidence that the activity was performed or caused to be performed by the owner of the property where the violation occurred.
Notwithstanding any provision of law to the contrary, of the total penalties paid by all persons found to have violated this article in any fiscal year, the commissioner shall ensure that $100,000 of that amount, or the total amount of penalties paid in the fiscal year if that amount is less than $100,000, is deposited in the Municipal Shoreline Protection Legal Fund established in section 450.

2.
Enforcement.
In addition to department staff, inland fisheries and wildlife game wardens, Department of Marine Resources marine patrol officers, all other law enforcement officers enumerated in Title 12, section 10401 and, pursuant to their delegated authority, the Maine Land Use Planning Commission and the Department of Agriculture, Conservation and Forestry, Bureau of Forestry shall enforce the terms of this article.
