This bill may
increase the number of civil suits filed in the court system. The additional
workload associated with the minimal number of new cases filed in the court
system does not require additional funding at this time. The collection of
additional filing fees will increase General Fund revenue by minor amounts. |

This resolve
authorizes Hemphill Farms Inc. to sue the Department of Agriculture,
Conservation and Forestry for damages in connection with actions taken by the
Department. If the plaintiffs are
successful, it is assumed that the first $400,000 would come from the Risk
Management Self-Insurance Fund and anything over $400,000 would come from the
General Fund. The amount and timing of any payment will depend on when the
suit is settled and its outcome. The
bill states that any award of damages cannot exceed $2,500,000
The Department of the Attorney General can absorb the additional costs of
defending this claim within existing resources. |
