Required Activity Unit Affected Local Cost
Requires local school administrative units (SAUs) to provide at least 4 hours of training to each of its school administrators, teachers and education technicians in topics related to de-escalation and behavior intervention beginning in the 2026-2027 school year and every 3rd year thereafter.  Also requires SAUs to offer training to all new school administrators, teachers and education technicians within 60 days of hiring beginning in the 2027-2028 school year. The required local activities in this bill may represent a state mandate pursuant to the Constitution of Maine. If the bill does require a local unit of government to expand or modify its activities so as to necessitate additional expenditures from local revenue, the state mandate provisions of the Constitution of Maine require either: (1) General Fund appropriations be provided to fund at least 90% of any additional necessitated local costs of the mandate; or (2) a Mandate Preamble be added to the bill and two-thirds of the members of each House vote to exempt the mandate from the funding requirement. If the bill does represent a state mandate and neither one of these actions occurs, the local units of government will not be required to implement the mandated activities.
Fiscal Detail and Notes
Requiring the Department of Education to convene teachers and other educators and experts to develop best practices in de-escalation and behavior intervention practices, to distribute the best practices to all SAUs in the State by September 1, 2026 and to maintain a list of de-escalation and behavior intervention trainings and experts who can help SAUs provide the trainings will increase costs to the department.  The ability of the department to complete these requirements without impacting other programs and services can not be determined at this time.
