The required local activities in this bill may represent a state mandate pursuant to the Constitution of Maine. If the bill does require a local unit of government to expand or modify its activities so as to necessitate additional expenditures from local revenue, the state mandate provisions of the Constitution of Maine require either: (1) General Fund appropriations be provided to fund at least 90% of any additional necessitated local costs of the mandate; or (2) a Mandate Preamble be added to the bill and two-thirds of the members of each House vote to exempt the mandate from the funding requirement. If the bill does represent a state mandate and neither one of these actions occurs, the local units of government will not be required to implement the mandated activities.
Fiscal Detail and Notes
The Department of Education will require ongoing General Fund appropriations of $273,817 in fiscal year 2025-26 and $241,417 in fiscal year 2026-27 to a newly created Menstrual Products Reimbursement program to reimburse school administrative units that serve students in grades 6 to 12 for 90% of the cost of making menstrual products available to students at no cost in all school bathrooms. Of that amount, $32,400 is one-time funding in fiscal year 2025-26 for the cost of purchasing and installing wall mounted boxes in bathrooms and $241,417 is ongoing funding beginning in fiscal year 2025-26 for the cost of menstrual products. 
According to the most recent data provided by the Department of Education, there are approximately 92,236 students in grades 6 through 12 and approximately 48.47%, or 44,707 are female.  This estimate assumes an average cost of $6.00 per menstruating student per school year and that each of the female students are menstruating. This estimate also assumes that the approximately 300 school buildings that serve students in grades 6 through 12 will install wall mounted boxes instead of coinless dispensers at an average cost of $15 per box and that there are 8 bathrooms per school building for a total of 2,400 bathrooms that will need to be supplied with menstrual products.
