The required
local activities in this bill may represent a state mandate pursuant to the
Constitution of Maine. If the bill does require a local unit of government to
expand or modify its activities so as to necessitate additional expenditures
from local revenue, the state mandate provisions of the Constitution of Maine
require either: (1) General Fund appropriations be provided to fund at least
90% of any additional necessitated local costs of the mandate; or (2) a
Mandate Preamble be added to the bill and two-thirds of the members of each
House vote to exempt the mandate from the funding requirement. If the bill
does represent a state mandate and neither one of these actions occurs, the
local units of government will not be required to implement the mandated
activities. |

The Department of
Education will require ongoing General Fund appropriations of $273,817 in
fiscal year 2025-26 and $241,417 in fiscal year 2026-27 to a newly created
Menstrual Products Reimbursement program to reimburse school administrative
units that serve students in grades 6 to 12 for 90% of the cost of making
menstrual products available to students at no cost in all school bathrooms.
Of that amount, $32,400 is one-time funding in fiscal year 2025-26 for the
cost of purchasing and installing wall mounted boxes in bathrooms and
$241,417 is ongoing funding beginning in fiscal year 2025-26 for the cost of
menstrual products. |

According to the
most recent data provided by the Department of Education, there are
approximately 92,236 students in grades 6 through 12 and approximately
48.47%, or 44,707 are female. This
estimate assumes an average cost of $6.00 per menstruating student per school
year and that each of the female students are menstruating. This estimate
also assumes that the approximately 300 school buildings that serve students
in grades 6 through 12 will install wall mounted boxes instead of coinless
dispensers at an average cost of $15 per box and that there are 8 bathrooms
per school building for a total of 2,400 bathrooms that will need to be
supplied with menstrual products. |
