Correctional and Judicial Impact Statements
Establishes new civil violations. May increase the number of civil suits filed in the court system.
The additional workload associated with the minimal number of new cases filed in the court system does not require additional funding at this time. The collection of additional fines and filing fees may increase General Fund or other dedicated revenue by minor amounts.
Fiscal Detail and Notes
It is estimated that the Department of Health and Human Services will require General Fund appropriations of $180,247 in fiscal year 2025-26 and $185,926 in fiscal year 2026-27 to establish 2 Health Services Consultant II positions, one Comprehensive Health Planner II position and one Senior Health Care Financial Analyst position to ensure professional staff have completed any required trainings, that the facilities have a process to ensure any statutorially required assessments are being completed while conducting surveys, to handle the process for additional penalties and for other added responsibilities, beginning July 1, 2025.
Additional costs to the Office of the Attorney General and to the Maine Human Rights Commission associated with the provisions of the Maine Quality Care Act are expected to be minor and can be absorbed within existing budgeted resources.
