|
This bill removes
the requirement for a child with a disability who had been determined
eligible for MaineCare or under the Katie Beckett option to undergo any
additional medical or disability determinations unless a parent or guardian
requests a new determination based on a belief that there has been a change
in the child's medical situation. This could be a failure to comply with
federal rules, specifically 20 Code of Federal Regulations (CFR) §416.994,
which could lead to penalty exposure. Additionally, this could lead to
individuals who would have been deemed ineligibile by the normal
redetermination process to remain on the program. As it is unknown what the
potential penalty amounts would be and how many ineligible individuals would
remain on the program, no estimate of the cost is made at this time. |
