The required local
activities in this bill may represent a state mandate pursuant to the
Constitution of Maine. If the bill does require a local unit of government to
expand or modify its activities so as to necessitate additional expenditures
from local revenue, the state mandate provisions of the Constitution of Maine
require either: (1) General Fund appropriations be provided to fund at least
90% of any additional necessitated local costs of the mandate; or (2) a
Mandate Preamble be added to the bill and two-thirds of the members of each
House vote to exempt the mandate from the funding requirement. If the bill
does represent a state mandate and neither one of these actions occurs, the
local units of government will not be required to implement the mandated
activities. |

This amendment
strikes the ongoing requirement in the bill that school administrative units
(SAUs) that serve students in grades 6 to 12 must make menstrual products
available to students at no cost in all school bathrooms and instead
establishes a one-year pilot program that requires all schools that serve
students in these same grades make menstrual products available at no cost
for the 2024-2025 school year only. The one-time General Fund appropriation
of $291,060 in fiscal year 2023-24 for the cost of purchasing and installing
coinless dispensers in bathrooms and the ongoing General Fund appropriations
of $272,999 per year beginning in fiscal year 2023-24 for the cost of
menstrual products are eliminated. |

As amended, this
bill includes one-time General Fund appropriations totaling $300,000 in
fiscal year 2024-25 for the cost of the pilot program. Of this amount.
$272,999 is appropriated for 90% of the cost of providing the menstrual
products and $27,001 is appropriated to reimburse schools that choose to
install a dispenser of menstrual product in school bathrooms. Reimbursement
to SAUs for the cost to install a dispenser of menstrual products is limited
to funds appropriated for this purpose. |
