The required local activities in this bill may represent a state mandate pursuant to the Constitution of Maine. If the bill does require a local unit of government to expand or modify its activities so as to necessitate additional expenditures from local revenue, the state mandate provisions of the Constitution of Maine require either: (1) General Fund appropriations be provided to fund at least 90% of any additional necessitated local costs of the mandate; or (2) a Mandate Preamble be added to the bill and two-thirds of the members of each House vote to exempt the mandate from the funding requirement. If the bill does represent a state mandate and neither one of these actions occurs, the local units of government will not be required to implement the mandated activities.
Fiscal Detail and Notes
This amendment strikes the ongoing requirement in the bill that school administrative units (SAUs) that serve students in grades 6 to 12 must make menstrual products available to students at no cost in all school bathrooms and instead establishes a one-year pilot program that requires all schools that serve students in these same grades make menstrual products available at no cost for the 2024-2025 school year only. The one-time General Fund appropriation of $291,060 in fiscal year 2023-24 for the cost of purchasing and installing coinless dispensers in bathrooms and the ongoing General Fund appropriations of $272,999 per year beginning in fiscal year 2023-24 for the cost of menstrual products are eliminated. 
As amended, this bill includes one-time General Fund appropriations totaling $300,000 in fiscal year 2024-25 for the cost of the pilot program. Of this amount. $272,999 is appropriated for 90% of the cost of providing the menstrual products and $27,001 is appropriated to reimburse schools that choose to install a dispenser of menstrual product in school bathrooms. Reimbursement to SAUs for the cost to install a dispenser of menstrual products is limited to funds appropriated for this purpose.
