The required local
activities in this bill may represent a state mandate pursuant to the
Constitution of Maine. If the bill does require a local unit of government to
expand or modify its activities so as to necessitate additional expenditures
from local revenue, the state mandate provisions of the Constitution of Maine
require either: (1) General Fund appropriations be provided to fund at least
90% of any additional necessitated local costs of the mandate; or (2) a
Mandate Preamble be added to the bill and two-thirds of the members of each
House vote to exempt the mandate from the funding requirement. If the bill
does represent a state mandate and neither one of these actions occurs, the
local units of government will not be required to implement the mandated
activities. |

This bill includes
ongoing General Fund appropriations totaling $4,579,762 beginning in fiscal
year 2022-23 to the Department of Economic and Community Development to
implement certain recommendations of the Commission To Increase Housing
Opportunities in Maine by Studying Zoning and Land Use Restrictions. |

$4,579,762 appropriation: |
|
1) $79,762 to a newly created Municipal
Housing Development Permit Review Board program for one Planning and Research
Assistance position to assist the board in conducting research and performing
administrative tasks. |
|
2) $89,760 to a newly created Municipal Land
Use and Zoning Ordinances Review Incentive Program for one Public Service
Coordinator I position to implement the program and to provide technical
assistance to municipalities. |
|
3) $115,560 to a newly created Municipal
Planning Assistance Grant and Incentive Program Fund program for one Public
Service Coordinator II position to serve as a municipal planning coordinator
providing expertise in zoning and land use ordinances to municipalities. |

4) $3,000,000 for grants to municipalities to
review municipal land use and zoning ordinance. (Mandate funding) |

5) $1,294,680 to assist municipalities in the
development and implementation of zoning and land use ordinances. (Mandate
