Amend the bill in section 1 in §9301 in subsection 2 in the last line (page 1, line 33 in L.D.) by inserting after the following: " 4" the following: ' , Title 16, chapter 3, subchapters 10 and 11 and 18 United States Code, Section 2703'
Amend the bill in section 1 in §9301 in subsection 4 by striking out all of paragraph F (page 2, lines 28 to 38 in L.D.) and inserting the following:
‘ F.
To provide geolocation information concerning the customer:
(1) For the purpose of responding to a customer's call for emergency services, to a public safety answering point; a provider of emergency medical or emergency dispatch services; a public safety, fire service or law enforcement official; or a hospital emergency or trauma care facility; or
’ (2) To a provider of information or database management services solely for the purpose of assisting in the delivery of emergency services in response to an emergency.
Amend the bill by adding after section 1 the following:
‘Sec. 2. Effective date. This Act takes effect July 1, 2020.’
Amend the bill by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.
SUMMARY
This amendment includes other exceptions, as found in the current law, to the release of customer personal information, such as for the release of portable electronic device content information and location information to a government entity. This amendment also removes the authorization of a provider to provide geolocation information regarding a customer to the customer's legal guardian or immediate family member in an emergency situation.
This amendment also provides an effective date of July 1, 2020 for the legislation.
