Amend the resolve by inserting before section 1 the following:

Emergency preamble. Whereas,  acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and

Whereas,  this resolve requires the commissioners of Hancock and Washington counties to submit a referendum question to the voters at the statewide election in November 2020; and

Whereas,  this resolve needs to take effect as soon as possible to provide time for the referendum question to be placed on the ballot; and

Whereas,  in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore, be it

Amend the resolve in section 3 in the 4th line (page 1, line 24 in L.D.) by striking out the following: "state and local government" and inserting the following: 'judiciary'

Amend the resolve in section 4 in the 2nd and 3rd lines (page 1, lines 31 and 32 in L.D.) by striking out the following: "state and local government" and inserting the following: 'judiciary'

Amend the resolve by adding after section 5 the following:

Sec. 6. Submission permitted. Resolved: That this resolve is approved only for the purpose of permitting its submission by the county commissioners of Hancock and Washington counties to the legal voters of Hancock and Washington counties at the general election held in November 2020.

Amend the resolve by adding before the summary the following:

Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.

SUMMARY

The resolve requires the commissioners of Hancock and Washington counties to submit the plans based on the result of the referendum question concerning the dissolution of Prosecutorial District Number 7 to the joint standing committee of the Legislature having jurisdiction over state and local government matters. This amendment instead requires the commissioners to report to the joint standing committee of the Legislature having jurisdiction over judiciary matters because of that committee's traditional jurisdiction overseeing district attorneys. The amendment directs the joint standing committee of the Legislature having jurisdiction over judiciary matters to introduce legislation in the 130th Legislature implementing the plans for the prosecutorial districts.

This amendment clarifies that the purpose of the resolve is to permit the submission of the question to the voters of Hancock and Washington counties.

This amendment adds an emergency preamble and emergency clause to provide sufficient time to place the referendum question on the ballot.
