An Act To Protect Water Quality by Prohibiting Consumer Fireworks in the Shoreland Zone

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 8 MRSA §223-A, sub-§8, ¶C  is enacted to read:

C Consumer fireworks may not be used within the shoreland zone, except during:

(1) The calendar week that includes July 4th;

(2) New Year's Eve and until 12:30 a.m. on New Year's Day;

(3) Labor Day; and

(4) Memorial Day.

This paragraph does not apply to a permitted fireworks display under section 227-A.

As used in this paragraph, "shoreland zone" has the same meaning as "shoreland areas" under Title 38, section 435; terms used to describe "shoreland areas" under Title 38, section 435 have the same meanings as under Title 38, section 436-A.

This bill bans the use of consumer fireworks in the shoreland zone except during the calendar week that includes July 4th and on New Year's Eve, Labor Day and Memorial Day. It exempts from this prohibition fireworks displays that have a permit issued by the Commissioner of Public Safety or the commissioner's designee.
