Resolve, To Implement an Intensive Drug Treatment Court Pilot Project in the Midcoast

Sec. 1. Department of Health and Human Services and judicial branch to establish an intensive drug treatment court pilot project in the midcoast area of the State. Resolved: That the Department of Health and Human Services, in consultation with the judicial branch, shall establish an intensive drug treatment court 2-year pilot project in the midcoast area of the State, referred to in this resolve as "the pilot project." The pilot project must serve 10 participants who live in the midcoast area of the State and meet the requirements for participation in the drug court programs established in the Maine Revised Statutes, Title 4, section 421. The Department of Health and Human Services shall provide case management and ancillary services that are currently provided as conditions of participation in drug court programs as well as intensive services to improve the likelihood of recovery. As many of the following services as necessary must be provided:

1. Outpatient substance use disorder treatment services;

2. Residential substance use disorder treatment services for 28 days;

3. Medication management and medication-assisted treatment;

4. Drug testing with a minimum of 2 random and observed tests per week;

5. Safe, sober and stable housing in properties directly owned or rented by the department;

6. Case management services;

7. Employment training;

8. Transportation services;

9. Incentives for use as rewards for altered behavior;

10. Forensic psychiatric evaluation;

11. Education including high school equivalency or community college classes;

12. Child care services;

13. Treatment services for the family members of the participants;

14. Medical and dental services;

15. Peer support; and

16. Public health nurse visits.

Sec. 2. Evaluation; professional development. Resolved: That the pilot project established in section 1 must be operational no later than November 1, 2019 and run for 2 years. The pilot project must be evaluated by an independent organization with experience in evaluation of specialty courts and substance use disorder. Funding for the pilot project must include funds for professional development for judges, case managers and other service providers as well as the independent evaluation required in this section.

Sec. 3. Report. Resolved: That the Department of Health and Human Services shall provide an interim report to the Joint Standing Committee on Health and Human Services no later than January 2, 2020 describing implementation of the pilot project. The department shall submit a final report no later than January 2, 2022 to the joint standing committee of the Legislature having jurisdiction over health and human services matters that includes details of the levels of services used by participants, outcome measures including measures of recovery and the independent evaluation required in section 2. The committee may report out legislation regarding the report to the Second Regular Session of the 130th Legislature.
