An Act To Advance Children's Cancer Research in Maine

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 29-A MRSA §527  is enacted to read:

§ 527 Children's cancer research donations

1 Donations upon vehicle registration.   When applying for or renewing a vehicle registration under this subchapter, a person may make a donation to support children's cancer research in this State. A person who offers a donation under this subsection shall include with the person's registration application or renewal fee funds sufficient to make the donation. Each vehicle registration or renewal form must contain a donation designation in substantially the following form: "Children's Cancer Research donation: ( ) $2, ( ) $5, ( ) $10, ( ) $20 or ( ) Other $... ."
2 Maine Children's Cancer Research Fund.   The Maine Children's Cancer Research Fund is established as a nonlapsing fund in the department. All donations for children's cancer research collected through vehicle registration or renewal pursuant to subsection 1 must be deposited into the Maine Children's Cancer Research Fund.
3 Recipient; rulemaking.   The Secretary of State shall determine by rule an entity to receive transfers pursuant to subsection 4. The entity must:
A Be a nonprofit organization with a specific program dedicated to children's cancer research;
B Employ a team of licensed pediatric oncology and hematology physicians; and
C Be dedicated to providing cancer treatment to children in Maine.

Rules adopted pursuant to this subsection are routine technical rules as provided in Title 5, chapter 375, subchapter 2-A.

4 Transfers for children's cancer research.   The Secretary of State shall transfer quarterly to the entity designated pursuant to subsection 3 the total amount deposited into the Maine Children's Cancer Research Fund pursuant to subsection 2. All funds transferred under this subsection must be used exclusively for children's cancer research.

This bill creates the option for an individual to make a donation upon vehicle registration or renewal in support of children's cancer research and establishes the Maine Children's Cancer Research Fund for collection of the donations. All donations are transferred quarterly to an entity determined by the Secretary of State and must be used exclusively for children's cancer research.
