Amend the amendment by inserting after the first paragraph after the title and before section 1 the following:

Sec. 1. 20-A MRSA §2902, sub-§1,  as amended by PL 2015, c. 329, Pt. A, §3, is repealed.

Sec. 2. 20-A MRSA §6353, sub-§§7 and 8,  as enacted by PL 1983, c. 661, §8, are amended to read:

7. School.   "School" means any public or private elementary or secondary school in the State.
8. Superintendent.   "Superintendent" means the superintendent of schools of a school administrative unit, or a person designated by the superintendent , and the chief administrative officer of a private school.’

Amend the amendment on page 2 in the first section 3 in §6358 by striking out all of subsection 2 (page 2, lines 15 to 17 in amendment) and inserting the following:

2. Local requirements authorized.   Immunization requirements more stringent than the provisions of this subchapter may be adopted by ordinance enacted by a municipality , or by regulation of a school board or by policy of a private school's governing board.’

Amend the amendment on page 2 by striking out all of section 4.

Amend the amendment on page 2 in the instructional paragraph in the first line (page 2, line 33 in amendment) by striking out the following: "inserting after section 2 the following:" and inserting the following: 'striking out all of section 2 and inserting the following:'

Amend the amendment by striking out all of the 2nd section 3 (page 2, lines 34 to 43 and page 3, lines 1 to 5 in amendment) and inserting the following:

Sec. 3. 20-A MRSA §6359,  as amended by PL 2001, c. 87, §1 and c. 326, §§4 to 6; PL 2003, c. 20, Pt. OO, §2 and affected by §4; and PL 2003, c. 689, Pt. B, §6, is repealed.

Amend the amendment on page 3 in section 5 in the 2nd paragraph in the 2nd and 3rd lines (page 3, lines 20 and 21 in amendment) by striking out the following: "and section 6359, subsection 6"

Amend the amendment on page 3 by striking out all of section 6 and inserting the following:

Sec. 6. Effective date. Those sections of this Act that amend the Maine Revised Statutes, Title 20-A, section 6353, subsections 7 and 8, Title 22, section 802, subsection 4-B, paragraph A and Title 22, section 8402, subsection 3, paragraph A and that repeal Title 20-A, section 2902, subsection 1, Title 20-A, section 6355, subsection 3 and Title 20-A, section 6359 take effect September 1, 2021. That portion of that section of this Act that amends Title 20-A, section 6358, subsection 2 takes effect September 1, 2021.’

Amend the amendment by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

SUMMARY

This amendment limits application of school immunization requirements to students attending public schools from prekindergarten to grade 12.
