An Act To Exclude Antique Tractors from the Laws Governing Motor Vehicle Racing

Emergency preamble. Whereas,  acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and

Whereas,  it is necessary that this Act take effect prior to the spring tractor racing season; and

Whereas,  in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore,

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 8 MRSA §567,  as enacted by PL 1973, c. 662, §2, is repealed and the following enacted in its place:

§ 567 Motorcycle and antique tractor racing excluded

This chapter does not apply to:

1 Motorcycle racing.   Motorcycle racing; or
2 Antique tractor racing.   Antique tractor racing. For purposes of this subsection, "antique tractor" means a tractor built during or before 1965 that meets the following requirements:
A The engine, frame, transmission and rear end and axle housings must be either original or manufacturer's replacements; and
B The engine may not exceed by more than 10% the manufacturer's recommended horsepower or revolutions per minute and may be no greater than 100 horsepower.

Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.

SUMMARY

This bill excludes antique tractors from regulation under the motor vehicle racing laws.
