Amend the amendment by striking out all of section 5 (page 1, lines 14 to 33 in amendment) and inserting the following:

Sec. 5. Referendum; effective date. This Act takes effect when approved only for the purpose of permitting its submission to the legal voters of the towns of Bar Harbor, Tremont, Southwest Harbor, Cranberry Isles, Mount Desert, Lamoine, Hancock, Sorrento, Gouldsboro, Trenton, Sullivan and Winter Harbor at an election called for that purpose and held within 2 years after the effective date of this Act. The elections must be called, advertised and conducted according to the law relating to municipal elections. The registrars shall make a complete list of all the eligible voters of the towns of Bar Harbor, Tremont, Southwest Harbor, Cranberry Isles, Mount Desert, Lamoine, Hancock, Sorrento, Gouldsboro, Trenton, Sullivan and Winter Harbor as described in this Act. The list prepared by the registrars governs the eligibility of a voter. For the purpose of registration of voters, the registrars of voters must be in session the next regular workday preceding the election. The subject matter of this Act is reduced to the following question:

"Shall 'An Act To Create the Bar Harbor Port Authority,' as passed by the Second Regular Session of the 128th Legislature, be accepted?"

The voters shall indicate by a cross or check mark against the word "Yes" or "No" their opinion of the same.

Upon its acceptance by a majority of the legal voters voting at the election in the Town of Bar Harbor and in at least 6 of the 11 other towns to which the question is submitted, this Act takes effect for all other purposes, as long as the total number of votes cast for and against the acceptance of this Act equals or exceeds 20% of the total number of votes cast for Governor in those towns at the last gubernatorial election. Another election may be held, if the total number of votes cast in the first election in a town does not equal or exceed 20%.

The result of the election must be declared by the municipal officers of the towns of Bar Harbor, Tremont, Southwest Harbor, Cranberry Isles, Mount Desert, Lamoine, Hancock, Sorrento, Gouldsboro, Trenton, Sullivan and Winter Harbor and due certificate filed by the respective town clerks with the Secretary of State.’

SUMMARY

This amendment extends to the towns of Bar Harbor, Tremont, Southwest Harbor, Cranberry Isles, Mount Desert, Lamoine, Hancock, Sorrento, Gouldsboro, Trenton, Sullivan and Winter Harbor the right to vote on the creation of the Bar Harbor Port Authority. Under the amendment, in order for the authority to be created it must be approved by the voters in the Town of Bar Harbor and in at least 6 of the 11 other towns to which the question is submitted.
