An Act To Safeguard the Rights of Private Child Care Businesses
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 22 MRSA §8309 is enacted to read:
§ 8309. Private child care facility; State's authority limited
Except to remedy unlawful discrimination pursuant to Title 5, chapter 337, the State may not prohibit the expulsion of a child from or compel the attendance of a child at an independently operated, privately owned child care facility.

This bill provides that the State may not prohibit the expulsion of a child from or compel the attendance of a child at an independently operated, privately owned child care facility except to remedy unlawful discrimination under the Maine Human Rights Act.
