Resolve, Directing the Department of Health and Human Services To Increase Reimbursement Rates for Home-based and Community-based Services

Sec. 1. Department of Health and Human Services to increase reimbursement rates for home-based and community-based services. Resolved: That the Department of Health and Human Services shall increase the reimbursement rates for home-based and community-based services in accordance with this section. The department shall raise the hourly reimbursement rate:

1. By 11% for personal support and self-directed services provided under the provisions of Chapter 101: MaineCare Benefits Manual, Chapter II, Section 96 and under the waiver services provisions of Section 19 and Chapter 5, Office of Elder Services Policy Manual, Section 63, In-Home and Community Support Services for Elderly and Other Adults or as otherwise set forth in the report "Rate Review for Personal Care and Related Services: Final Rate Models" prepared by Burns & Associates, Inc. and dated February 1, 2016;

2. By 14% for home health aide, registered nurse and licensed practical nurse services provided under the waiver services provisions of Chapter 101: MaineCare Benefits Manual, Chapter II, Section 19 or as otherwise set forth in the report "Rate Review for Personal Care and Related Services: Final Rate Models" prepared by Burns & Associates, Inc. and dated February 1, 2016;

3. By 14% for home health aide, registered nurse, licensed practical nurse and independent registered nurse services under the provisions of Chapter 101: MaineCare Benefits Manual, Chapter II, Section 96 or as otherwise set forth in the report "Rate Review for Personal Care and Related Services: Final Rate Models" prepared by Burns & Associates, Inc. and dated February 1, 2016; and

4. By 14% for registered nurse and independent registered nurse services under the provisions of Chapter 5, Office of Elder Services Policy Manual, Section 63 or as otherwise set forth in the report "Rate Review for Personal Care and Related Services: Final Rate Models" prepared by Burns & Associates, Inc. and dated February 1, 2016; and be it further

Sec. 2. Deadline for increase established. Resolved: That the Department of Health and Human Services shall increase the reimbursement rates in accordance with section 1 by July 1, 2018.

SUMMARY

This resolve directs the Department of Health and Human Services to increase reimbursement rates for home-based care services consistent with the recommendations made by Burns & Associates, Inc. in its report "Rate Review for Personal Care and Related Services: Final Rate Models" dated February 1, 2016. The first half of this increase was ratified by the 127th Legislature through Public Law 2015, chapter 267.
