An Act To Recognize Preexisting Land Uses
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 12 MRSA §685-C, sub-§12 is enacted to read:
12. Proof of legal existence of nonconforming uses; limitations. The commission may not require proof that a preexisting, grandfathered nonconforming use legally existed more than 20 years.
SUMMARY
This bill prohibits the Maine Land Use Planning Commission from requiring proof that preexisting, grandfathered nonconforming land uses were in legal existence for more than 20 years.
