An Act To Clarify Occupancy for Tents, Campers, Trailers and Other Devices used for Camping in Unorganized Townships
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 12 MRSA §682, sub-§18, as amended by PL 2009, c. 16, §1, is further amended to read:
18. Transient occupancy. "Transient occupancy" means occupancy that does not exceed 120 days in a calendar year. For purposes of this subsection, for a tent, tent trailer, pickup camper, recreational vehicle, trailer or similar device used for camping, occupancy is determined by the length of time a person is present in the tent, trailer, camper, recreational vehicle or similar device.
Sec. 2. 12 MRSA §685-C, sub-§12 is enacted to read:
12. Unoccupied camping devices. An unoccupied tent, tent trailer, pickup camper, recreational vehicle, trailer or similar device used for camping may be stored at a campsite or campground in a space reserved for camping.

This bill clarifies that occupancy in the definition of "transient occupancy" for the unorganized territories is determined by the length of time a person is present and allows the storage of unoccupied camping devices such as tents, tent trailers, pickup campers, recreational vehicles and trailers at campgrounds or campsites in reserved camping spaces.
