Amend the amendment by inserting after section 2 the following:

Sec. 3. 17-A MRSA §852, sub-§4  is enacted to read:

4   The court, in determining the appropriate sentence of a person convicted of a violation of subsection 1, paragraph B, shall treat the age of the person promoted into prostitution as an aggravating sentencing factor.

Amend the amendment in section 4 in paragraph A-1 in the last line (page 2, line 3 in amendment) by striking out the following: " Class C" and inserting the following: ' Class B'

Amend the bill by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

SUMMARY

This amendment requires the court to treat the age of the person promoted into prostitution as an aggravating sentencing factor. This amendment also increases the class of crime for sex trafficking if the person who is trafficked is less than 18 years of age from a Class C crime to a Class B crime.
