An Act To Clarify the Appointment Process

Sec. 1. 1 MRSA §75  is enacted to read:

§ 75.  Construction of statutes relating to appointments

If a statute provides that an entity or individual provide to the Governor names of candidates for appointment to a position, but does not specify the number of names of candidates that must be provided, that statute is construed to mean that the entity or individual must provide the Governor a list of at least 3 qualified candidates.

SUMMARY

This bill clarifies the appointment process in those instances when an individual or entity is required by statute to provide the Governor names of candidates for appointment, but the number of candidates is not specified, to require that a list of at least 3 qualified candidates be provided to the Governor.
