Amend the bill in section 1 in §3109 by striking out all of subsection 5 (page 2, lines 22 to 42 in L.D.) and inserting the following:

‘ 5. Healthy Local Foods Incentive Fund. The Healthy Local Foods Incentive Fund, referred to in this subsection as "the fund," is a revolving, nonlapsing fund administered by the department to carry out the purposes of the program. The fund includes funds received from a hospital organization in the State pursuant to the implementation strategy to meet the community's health needs identified through a community health needs assessment under Section 501(r) of the United States Internal Revenue Code of 1985, as amended, and any other funds that the department considers suitable.’

Amend the bill in section 1 in §3109 in subsection 6 in the last 2 lines (page 3, lines 2 and 3 in L.D.) by striking out the following: " subsection 5, paragraph D" and inserting the following: ' subsection 5'

SUMMARY

This amendment, which is the majority report of the committee, removes the funding sources for the bill's Healthy Local Foods Incentive Fund that come from bonus payments for the Department of Health and Human Services for the department's administration of the federal Supplemental Nutrition Assistance Program and from the collection of the program's overpayment claims.
