An Act Regarding Recovery of Emergency Response Costs Related to an OUI Offense
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 29-A MRSA §2411, sub-§9 is enacted to read:
9. Emergency response costs. A person who, while committing OUI under this section, proximately causes an incident requiring an appropriate emergency response by a private or public law enforcement agency, fire department or organization that provides emergency medical services is liable for the costs of that response up to an amount of $2,500.
SUMMARY
This bill makes a person who, while criminally operating a motor vehicle while intoxicated, proximately causes an incident requiring an emergency response liable for the costs of that response up to an amount of $2,500.
