Amend the bill in section 1 in §2769 by striking out all of subsection 2 (page 1, lines 22 to 25 in L.D.) and inserting the following:

2 Application; exclusion.   The requirements of this section do not apply to a prescription for:
A Solid oral doses of antibiotics; or
B Solid oral doses that are dispensed in their original container as indicated in the federal Food and Drug Administration Prescribing Information or are customarily dispensed in their original packaging to assist a patient with compliance.

Amend the bill by adding after section 1 the following:

Sec. 2. Application. The requirements of this Act apply to all policies, contracts and certificates executed, delivered, issued for delivery, continued or renewed in this State on or after January 1, 2016. For purposes of this Act, all contracts are deemed to be renewed no later than the next yearly anniversary of the contract date.’

This amendment retains the provision of the bill that requires certain health insurance carriers to allow prescriptions to be dispensed by a pharmacist for less than a 30-day supply if it is in the best interest of the patient, but excludes prescriptions for solid oral doses of antibiotics and solid oral doses dispensed in their original container.

The amendment makes the change apply to all policies and contracts issued or renewed on or after January 1, 2016.
