An Act To Allow the Governor To Review Routine Technical Rules

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 5 MRSA §8052, sub-§9  is enacted to read:

9 Provisional adoption period for Governor review.   Notwithstanding any provision of law to the contrary, a routine technical rule governed by this subchapter, prior to final adoption, is provisionally adopted for the first 12 months following its effective date. During this 12-month period, the Governor may refer the provisionally adopted routine technical rule to the joint standing committee of the Legislature having jurisdiction over the subject matter of the rule for review in the same manner as a major substantive rule under section 8072. If the Governor fails to act during the 12-month period, the rule is considered finally adopted.

This bill requires all routine technical rules to be provisionally adopted for 12 months following proposal. During this period, the Governor may refer the rule to the joint standing committee of the Legislature having jurisdiction over the subject matter of the rule for review in the same manner as a major substantive rule.
