An Act To Allow Active Members and Veterans of the Armed Forces Who Are at Least 18 Years of Age and under 21 Years of Age To Consume Alcohol at Eligible Veterans' Organization Posts and American Legion Halls

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 28-A MRSA §2051, sub-§5,  as enacted by PL 2003, c. 452, Pt. P, §4 and affected by Pt. X, §2, is amended to read:

5. Exceptions.   A minor is not in violation of subsection 1, paragraph E-1 or F-1 if the minor possesses:
A.  Liquor Subsection 1, paragraph E-1 or F-1 if the minor possesses liquor or imitation liquor or equipment described in subsection 1, paragraph F-1 in the scope of the minor's employment;
B.  Liquor Subsection 1, paragraph E-1 or F-1 if the minor possesses liquor or imitation liquor in a home in the presence of the minor's parent, guardian or custodian, as defined in Title 22, section 4002; or
C.  Equipment Subsection 1, paragraph E-1 or F-1 if the minor possesses equipment described in subsection 1, paragraph F-1 in the minor's own home under the supervision of the minor's parent, guardian or custodian, as defined in Title 22, section 4002 . ; or
D Subsection 1, paragraph A, B, C or E-1 if the minor is a member or veteran of the United States Armed Forces or state military forces as described in Title 37-B, section 102 on the premises of a veterans' organization eligible to receive a beano or bingo license under Title 17, section 314.

Sec. 2. 28-A MRSA §2081, sub-§2,  as amended by PL 2003, c. 452, Pt. P, §9 and affected by Pt. X, §2, is further amended to read:

2. Exceptions.   This section does not apply to a person who serves liquor or imitation liquor to a minor in a home in the presence of the minor's parent, guardian or custodian, as defined in Title 22, section 4002 , or, if the minor is a member or veteran of the United States Armed Forces or state military forces as described in Title 37-B, section 102, on the premises of a veterans' organization eligible to receive a beano or bingo license under Title 17, section 314.

SUMMARY

This bill allows a person who is at least 18 years of age but under 21 years of age who is a member or veteran of the United States Armed Forces or state military forces to be served and consume alcohol on the premises of a veterans' organization founded, chartered or organized in the State that is eligible to receive a beano or bingo license from the Chief of the State Police.
