Amend the resolve by striking out the title and substituting the following:
‘Resolve, Directing the Department of Professional and Financial Regulation To Study the Dental Practice Laws and Recommend Changes To Streamline the Licensure and Scope of Practice Provisions’
Amend the resolve by striking out everything after the title and before the summary and inserting the following:
‘Emergency preamble. Whereas, acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and
Whereas, the Department of Professional and Financial Regulation is prepared to begin a comprehensive review of the dental practice laws in order to recommend changes to streamline the licensure and scope of practice provisions in a timely fashion and report to the Second Regular Session of the 127th Legislature; and
Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore, be it
Sec. 1. Commissioner of Professional and Financial Regulation to study the dental practice laws and recommend changes. Resolved: That the Commissioner of Professional and Financial Regulation, or the commissioner's designee, in consultation with interested parties, shall conduct a study of the Maine Revised Statutes, Title 32, chapter 16 and any laws associated with the provisions of that chapter and recommend changes that streamline the licensure and scope of practice provisions to more accurately reflect the delivery and practice settings of dental services in this State; and be it further
Sec. 2. Reporting date established. Resolved: That the Commissioner of Professional and Financial Regulation shall report any recommendations from the study under section 1 to the Joint Standing Committee on Labor, Commerce, Research and Economic Development on or before February 15, 2016. The joint standing committee may report out a bill to the Second Regular Session of the 127th Legislature related to the commissioner's report.
Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.’
SUMMARY
This amendment replaces the resolve and changes the title. It adds an emergency preamble and emergency clause and directs the Commissioner of Professional and Financial Regulation to study laws pertaining to dental practitioners, recommend changes that streamline the licensure and scope of practice provisions and submit any recommendations from the study to the Joint Standing Committee on Labor, Commerce, Research and Economic Development on or before February 15, 2016. It authorizes the committee to report out a bill related to the commissioner's report to the Second Regular Session of the 127th Legislature.
