An Act To Facilitate the Completion of Training by Certain Cosmetology Students

Emergency preamble. Whereas,  acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and

Whereas,  state law requires cosmetology students to obtain 1,500 hours of instruction in an approved cosmetology school or 2,500 hours of training in order to receive a license to practice cosmetology; and

Whereas,  Mr. Bernard's School of Hair Fashion, Inc., with campuses in Bangor and Lewiston, closed unexpectedly leaving a number of cosmetology students unable to finish their licensing requirements in instruction hours; and

Whereas,  many cosmetology students of Mr. Bernard's School of Hair Fashion, Inc., have completed a majority of the instruction hours required for licensing but cannot practically finish the requirements within a reasonable period of time due to limited space and waiting lists for admission at other approved cosmetology schools and programs; and

Whereas,  in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore,

Be it enacted by the People of the State of Maine as follows:

Sec. 1. Students of Mr. Bernard's School of Hair Fashion, Inc., permitted to finish cosmetology instruction hour requirements through experience in the practice of cosmetology as trainees. A student of Mr. Bernard's School of Hair Fashion, Inc., who was attending the school at the time of the school's closure and has completed at least 1,000 instruction hours in cosmetology may qualify for a license under the Maine Revised Statutes, Title 32, section 14226, subsection 3 by fulfilling the student's remaining required instruction hours for licensure through experience in the practice of cosmetology as a trainee at a rate of one training hour for every .6 of an instruction hour.

Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.

This bill allows a cosmetology student of the now-closed Mr. Bernard's School of Hair Fashion, Inc., who has at least 1,000 hours of the required 1,500 instruction hours for licensure in cosmetology to fulfill the remaining required instruction hours through experience in the practice of cosmetology as a trainee at a rate of one training hour for every .6 of an instruction hour.
