Amend the amendment in section 1 in §2432 in subsection 2 in the last line (page 2, line 6 in amendment) by striking out the following: " subsection 5" and inserting the following: ' subsection 4'

Amend the amendment in section 1 by inserting after §2432 the following:

§ 2433 Disposition of funds in the fund after April 30, 2017

Beginning May 1, 2017, notwithstanding section 2431, the commissioner shall administer the fund. Notwithstanding section 2432, the commissioner may distribute funds in the fund to the University of Maine Cooperative Extension for the purposes specified in section 2432, subsections 3 and 4 only.

Amend the amendment in section 2 in §4911 in subsection 1 in the 2nd line (page 2, line 22 in amendment) by striking out the following: " 20¢" and inserting the following: ' 10¢'

Amend the amendment in section 2 in §4911 in subsection 1 in the 6th line (page 2, line 26 in amendment) by striking out the following: " 20¢" and inserting the following: ' 10¢'

Amend the amendment in section 2 in §4911 in subsection 2 in paragraph C in the 2nd line (page 2, line 36 in amendment) by inserting after the following: " the board;" the following: ' and'

Amend the amendment in section 2 in §4911 in subsection 2 in paragraph D in the 2nd line (page 2, line 38 in amendment) by striking out the following: " number; and" and inserting the following: ' number.'

Amend the amendment in section 2 in §4911 in subsection 2 by striking out all of paragraph E (page 3, lines 1 to 3 in amendment).

Amend the amendment in section 2 in §4911 by striking out all of subsection 4 (page 3, lines 9 to 11 in amendment)

Amend the amendment in section 2 in §4911 in subsection 6 in the first line (page 3, line 21 in amendment) by striking out the following: " and every April 1st thereafter"

Amend the amendment in section 2 in §4911 in subsection 6 in the 2nd and 3rd lines (page 3, lines 22 and 23 in amendment) by striking out the following: " subsections 1 and 4" and inserting the following: ' subsection 1'

Amend the amendment in section 2 in §4911 in subsection 6 by striking out all of the blocked paragraph (page 3, lines 25 to 34 in amendment) and inserting the following:

The board shall review the fee imposed under this chapter between January 1, 2017 and April 1, 2017 and, following this review, shall submit a report to the joint standing committee of the Legislature having jurisdiction over pest management matters that includes the quantity of registered products subject to the fee imposed under subsection 1 and the total amount of funds disbursed to Maine Revenue Services.

Amend the amendment in section 2 in §4911 by inserting after subsection 7 the following:

8 Repeal.   This chapter is repealed May 1, 2017.

Amend the amendment in section 2 in §4911 by renumbering the subsections to read consecutively.

Amend the amendment by striking out all of section 3 and inserting the following:

Sec. 3. Appropriations and allocations. The following appropriations and allocations are made.

summary

This amendment decreases the pesticide container fee proposed under Committee Amendment "A" to 10¢ per container and removes the exemption from the fee for packages sold by retail stores of less than 7,000 square feet of space. This amendment repeals the pesticide container fee on May 1, 2017. The Commissioner of Agriculture, Conservation and Forestry is given administrative control over the Animal and Plant Disease and Insect Control Fund after that date and provided the authority to disburse the funds to the University of Maine Cooperative Extension for pest management and pesticide safety education and laboratory costs.
