An Act To Prohibit Fuel Temperature Compensation When Fuel is Dispensed to Outdoor Tanks
Sec. 1. 10 MRSA §2353, as amended by PL 1989, c. 24, §3, is further amended to read:
§ 2353. Technical requirements for commercial devices
The specifications, tolerances and other technical requirements for commercial weighing and measuring devices as adopted by the National Conference on Weights and Measures and published in National Bureau of Standards Handbook 44, "Specifications, Tolerances and Other Technical Requirements for Commercial Weighing and Measuring Devices," or published in the National Institute of Standards and Technology Handbook 44, 1990, and supplements or revisions to those publications, shall apply to commercial weighing and measuring devices in the State, except insofar as modified or rejected by regulation and except that a person, when dispensing a refined petroleum product to a holding tank located outside, is prohibited from adjusting the indication and registration of the measured volume of the refined petroleum product being dispensed based on a set temperature.
