An Act To Authorize the Dispensing of Eyeglasses with an Expired Prescription
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 32 MRSA §2417, sub-§7 is enacted to read:
7. Replacement of eyeglasses with expired prescription. Notwithstanding any other provision of this section, upon presentation of an expired prescription for ophthalmic lenses by a patient, an optometrist shall dispense a set of eyeglasses with the prescribed ophthalmic lenses and advise the patient of the consequences of not renewing the prescription by receiving an eye examination under subsection 3. An optometrist is immune from liability in complying with this subsection.
SUMMARY
This bill requires an optometrist, upon presentation of an expired prescription for ophthalmic lenses by a patient, to dispense without liability prescription glasses pursuant to the expired prescription and to inform the patient of the consequences of not renewing the prescription by receiving a proper eye examination.
