An Act To Require the Attorney General To Investigate the Death of a Person in Police Custody or in a Correctional Facility

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 5 MRSA §200-A,  as amended by PL 1995, c. 200, §1, is further amended by adding at the end a new paragraph to read:

The Attorney General shall investigate as a criminal matter the death of a person who at the time of death was in police custody or was an inmate in a state or county correctional facility. The Department of Corrections, the county jail administrator or the law enforcement agency, as appropriate, shall notify the Attorney General of the death as soon as practicable.
