Amend the bill by striking out the title and substituting the following:

‘An Act To Recognize and Provide for the Right To Hunt for Sustenance in Aroostook County for Maliseet and Micmac Tribal Members’

Amend the bill by striking out everything after the enacting clause and before the summary and inserting the following:

Sec. 1. 12 MRSA §10853, sub-§17  is enacted to read:

17 Moose permit allocations for the Houlton band of Maliseet Indians and the Aroostook Band of Micmacs in Aroostook County.   The commissioner shall annually issue 33 moose permits to enrolled members of the Houlton Band of Maliseet Indians and 33 moose permits to enrolled members of the Aroostook Band of Micmacs. The permits must be valid only in wildlife management districts located in Aroostook County. The commissioner may limit the number of moose permits allocated pursuant to this subsection based on biological data and sound management practices. Moose permits allocated pursuant to this subsection may be distributed among tribal members as determined by the tribes and are subject to the provisions of this Part. A permit issued under this subsection is not subject to a fee.

This amendment replaces the bill and directs the Commissioner of Inland Fisheries and Wildlife to issue annually 33 moose permits to enrolled members of the Houlton Band of Maliseet Indians and 33 moose permits to enrolled members of the Aroostook Band of Micmacs valid only in wildlife management districts located in Aroostook County. The commissioner may limit the number of moose permits and all permits are subject to the provisions pertaining to moose hunting. The permits are free of charge.
