Amend the bill by striking out the title and substituting the following:

‘An Act Regarding Photographs on Electronic Benefits Transfer Cards’

Amend the bill by striking out everything after the enacting clause and before the summary and inserting the following:

‘Sec. 1. 22 MRSA §3104, sub-§15 is enacted to read:

15. Photographs on electronic benefits transfer cards. If the department requires a photograph of a recipient to be included on an electronic benefits transfer card, either at the time of issuance or upon replacement, the department shall adopt rules in accordance with regulations promulgated by and with written approval of the United States Department of Agriculture. Rules adopted pursuant to this subsection are major substantive rules as defined in Title 5, chapter 375, subchapter 2-A.’

SUMMARY

This amendment, which is a minority report of the committee, replaces the bill. It requires that the Department of Health and Human Services adopt rules if it requires the photograph of a recipient of an electronic benefits transfer card be added to the card either at issuance or replacement. Rules to add a photograph to the card are major substantive rules.
