Amend the bill in section 1 by striking out all of subsection 2 (page 1, lines 4 to 10 in L.D.) and inserting the following:

2. Contingent effective date.  This section does not take effect until at least 10 other states or a number of states with a collective population of 30,000,000 3 of the other New England states, Connecticut, Massachusetts, New Hampshire, Rhode Island and Vermont, have enacted laws that prohibit the sale of motor fuel containing corn-based ethanol. The Commissioner of Agriculture, Conservation and Forestry shall notify the Revisor of Statutes when 10 other states or a number of states having a collective population of 30,000,000 3 of the other New England states have adopted laws that prohibit the sale of motor fuel containing corn-based ethanol.’

SUMMARY

This amendment, which is the minority report of the committee, provides that the prohibition on the sale of motor fuel containing corn-based ethanol does not take effect until at least 3 of the other New England states, Connecticut, Massachusetts, New Hampshire, Rhode Island and Vermont, have enacted laws that prohibit the sale of motor fuel containing corn-based ethanol.
