Amend the bill in section 1 in paragraph A by striking out all of subparagraph (1) (page 1, lines 7 to 12 in L.D.) and inserting the following:
‘(1) Three members are appointed by the state board and must be members of the state board, and those 3 members shall nominate the other 4 members who must be approved by a majority vote of the state board for appointment to the commission. Each nomination by the state board is subject to review by the joint standing committee of the Legislature having jurisdiction over education matters and to confirmation by the Senate.
Amend the bill by striking out all of section 2 (page 2, lines 18 to 23 in L.D.) and inserting the following:
‘Sec. 2. Transition. Notwithstanding the Maine Revised Statutes, Title 20-A, section 2405, subsection 8, members of the Maine Charter School Commission serving on the effective date of this Act continue to serve until the completion of their terms. Their successors are nominated and appointed as provided in Title 20-A, section 2405, subsection 8, paragraph A.’
SUMMARY
This amendment is the majority report of the committee. The amendment makes changes to the provisions in the bill that apply to the appointment of 4 of the 7 members of the Maine Charter School Commission. Instead of having the Governor appoint the 4 commission members nominated by the 3 members of the State Board of Education appointed to the commission by the state board, the amendment provides that the 4 commission members are nominated by those 3 members of the state board appointed to the commission and are subject to review by the joint standing committee of the Legislature having jurisdiction over education matters and to confirmation by the Senate.
