An Act To Allow Condominium and Homeowners Associations To Establish Swim Areas

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 12 MRSA §1900, sub-§1, ¶A-1  is enacted to read:

A-1 "Common interest development" means a homeowners association, unit owners association or condominium owners association.

Sec. 2. 12 MRSA §1900, sub-§1, ¶C,  as enacted by PL 2009, c. 312, §1, is amended to read:

C. "Qualified entity" means a common interest development, camping area, recreational camp or governmental entity or governmentally sponsored group.

Sec. 3. 12 MRSA §1900, sub-§4,  as enacted by PL 2009, c. 312, §1, is amended to read:

4. Issuance of permit.  The director may issue a permit only to a qualified entity to establish and maintain a developed swim area within the water safety zone designed to provide recreational swimming opportunities for the public or, in the case of a common interest development, to provide recreational swimming opportunities for members of the common interest development.

This bill allows homeowners associations, unit owners associations and condominium owners associations to be issued a permit by the Director of the Bureau of Parks and Lands within the Department of Agriculture, Conservation and Forestry to establish developed swim areas.
