An Act To Promote the Disposal of Unused Medications
Sec. 1. 32 MRSA §13791-A is enacted to read:
§ 13791-A. Prescriptions no longer required; disposal
A prescription drug or legend drug may be returned to the issuing pharmacy by the person for whom the prescription drug or legend drug was dispensed, by the person's guardian or by the staff of a residential facility providing services to the person. The pharmacy shall accept that prescription drug or legend drug and dispose of it in a manner that is designed to be effective, secure and in compliance with local, state and federal environmental requirements, including the federal Resource Conservation and Recovery Act of 1976, as amended. A fee may not be charged by the pharmacy for the cost of disposal.

This bill allows the return of a prescription drug to the issuing pharmacy by the person for whom the drug was dispensed, by the person's guardian or by the staff of a residential facility providing services to the person. The pharmacy is required to dispose of the prescription drug in a manner that complies with local, state and federal environmental requirements. The cost of disposal is borne by the issuing pharmacy.
