An Act To Provide Additional Oversight over the Management of the Department of Health and Human Services

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 22-A MRSA §204-A  is enacted to read:

§ 204-A Appointments subject to legislative review

The Governor shall appoint the following, subject to review by the joint standing committee of the Legislature having jurisdiction over health and human services matters and confirmation by the Senate:

1 Center for Disease Control and Prevention.   The Director of the Maine Center for Disease Control and Prevention;
2 Dorothea Dix.   The Superintendent of the Dorothea Dix Psychiatric Center; and
3 Riverview.   The Superintendent of Riverview Psychiatric Center.

Sec. 2. 22-A MRSA §205, sub-§4,  as amended by PL 2007, c. 539, Pt. N, §44, is further amended to read:

4. Appointments.  All deputy commissioners, all office directors, the regional systems integration directors and the superintendents of any state institutions are appointed by the commissioner and serve at the pleasure of the commissioner except as otherwise provided pursuant to section 204-A.

Deputy commissioners and office directors appointed pursuant to this subsection must have educational qualifications and professional experience directly related to the functions of and services provided by the relevant unit or office.

SUMMARY

This bill requires the Director of the Maine Center for Disease Control and Prevention, the Superintendent of the Dorothea Dix Psychiatric Center and the Superintendent of Riverview Psychiatric Center to be appointed by the Governor subject to review by the joint standing committee of the Legislature having jurisdiction over health and human services matters and confirmation by the Senate.
